Family law attorney fees vary based on case complexity. Simple uncontested matters may have flat fees, while contested divorces typically require retainers and hourly billing. We offer payment plans and transparent pricing. During your free evaluation, we'll discuss fees specific to your situation.
North Carolina requires a one-year separation period before filing for absolute divorce. After filing, uncontested divorces may finalize in 45-60 days, while contested cases can take 6-18 months depending on property division, custody disputes, and court schedules. Charlotte residents can file in the venue where they or their spouse meet residency requirements; Vasquez Law Firm handles contested family litigation venued in Johnston, Harnett, Wayne, or Wake County. Simple uncontested divorce paperwork is available to Charlotte residents statewide.
North Carolina courts determine custody based on the child's best interests. Factors include each parent's ability to provide care, the child's relationship with each parent, stability, and any history of domestic violence. Courts don't automatically favor mothers or fathers.
North Carolina uses statewide child support guidelines based on both parents' incomes, number of children, custody arrangement, healthcare costs, and childcare expenses. The guidelines apply unless the court finds them inappropriate for specific circumstances. The same formula governs Charlotte residents regardless of which NC county the case is filed in.
North Carolina follows equitable distribution, meaning marital property is divided fairly but not necessarily equally. The court considers factors like each spouse's income, property brought to marriage, length of marriage, and contributions to marital assets.
Alimony (spousal support) may be awarded based on one spouse's dependency and the other's ability to pay. Factors include marriage length, standard of living, each spouse's earnings and earning capacity, and marital misconduct. North Carolina law bars alimony for spouses who committed adultery. Vasquez Law Firm litigates alimony claims for Charlotte clients in Johnston, Harnett, Wayne, or Wake County family courts.
While not legally required, separation agreements are highly recommended. They establish terms for property division, custody, support, and other issues during separation. A well-drafted agreement can simplify divorce proceedings and provide clarity during separation.
North Carolina law allows grandparents to seek visitation under limited circumstances, such as when parents are divorced or deceased. The grandparents must prove visitation is in the child's best interests and won't interfere with the parent-child relationship. We represent Charlotte-area grandparents in Johnston, Harnett, Wayne, or Wake County family courts.
Domestic violence includes physical harm, threats, sexual assault, stalking, and harassment between current or former intimate partners, family members, or household members. Victims can seek Domestic Violence Protective Orders (DVPOs) for immediate protection.

NC Family Law for Charlotte Residents: What You Should Know
NC Family Law and Divorce Requirements
Family law in North Carolina is governed primarily by N.C. General Statutes Chapter 50 (divorce and alimony), Chapter 50A (child custody jurisdiction under the UCCJEA), and Chapter 50B (domestic violence protective orders). The same NC statutes apply to every county. For Charlotte clients we represent, contested cases are heard in Johnston County (207 E Johnston St, Smithfield), Harnett County (Lillington), Wayne County (Goldsboro), or Wake County (Raleigh) family courts depending on venue. North Carolina is unique in requiring a mandatory one-year separation period before a spouse can file for absolute divorce under N.C.G.S. § 50-6. During this separation, critical legal actions must be taken: claims for equitable distribution of marital property under N.C.G.S. § 50-20 and claims for alimony under N.C.G.S. § 50-16.3A must be filed before the divorce is finalized, or those rights are permanently waived.
Child Custody and Support
Child custody in North Carolina is determined under the best-interest-of-the-child standard established in N.C.G.S. § 50-13.2. Family courts require mediation for contested custody cases before a trial can be scheduled, and judges evaluate factors including each parent's living situation, the child's existing relationships, and any history of domestic violence. Child support is calculated using the North Carolina Child Support Guidelines, which follow an income shares model based on both parents' gross incomes, the number of children, and the custody arrangement. For domestic violence situations, victims can obtain emergency ex parte Domestic Violence Protective Orders (DVPOs) under N.C.G.S. § 50B-2, which can grant exclusive possession of the residence, temporary custody, and no-contact provisions. Vasquez Law Firm files DVPOs in Johnston, Harnett, and Wayne County (not Wake County).
